Terms of Service for ArchiView

1. Acceptance of Terms
By downloading, installing, or using the ArchiView desktop application ("the Application"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Application.
2. Description of Service
ArchiView is an open-source, offline-first desktop software application used to catalog, archive, and transcribe historical documents. It includes an optional feature to synchronize your local workspace data with your personal Google Drive account.
3. Google Drive Integration
If you choose to use the Google Drive synchronization feature, you must grant ArchiView access to your Google account.
- You understand that ArchiView acts strictly as a client that connects directly to Google's APIs.
- ArchiView only accesses and modifies files and folders that it has explicitly created in your Google Drive.
- You are solely responsible for managing your Google Drive storage limits and maintaining access to your Google account.
4. User Responsibilities and Data Ownership
- Data Ownership: You retain full ownership of all data, texts, and attachments you create, upload, or process using ArchiView.
- Backups: While ArchiView provides synchronization and backup features, you are entirely responsible for maintaining independent backups of your important data. We do not guarantee against data loss.
- Lawful Use: You agree not to use ArchiView to store or synchronize illegal, infringing, or malicious content.
5. Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE, UNINTERRUPTED, OR ABSOLUTELY SECURE.
6. Limitation of Liability
IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES, DATA LOSS, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE APPLICATION OR THE USE OR OTHER DEALINGS IN THE APPLICATION.
7. Open Source License
ArchiView is open-source software. While these Terms of Service govern the use of the hosted synchronization hubs and our API integrations, the underlying source code of the Application is governed by its respective open-source license (e.g., MIT License) as detailed in the project's repository.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Continued use of the Application after changes are published constitutes your acceptance of the new terms.
